Founding Advisor Program Terms
Summary
- Mecavoy does not charge a fee to apply to the Program. Submitting an Application does not oblige you to sign the Advisor Agreement.
- To apply, create an Advisor Account and confirm your email address with the six-digit code that Mecavoy sends you. In the Advisor Console you can see the status of your Application, withdraw it and, within the limits in Section 4.7, apply again. Mecavoy intends to move Advisor Accounts to the Mecavoy Service, which is scheduled to open to founding advisors for early access in December 2026, and will email you at least 30 days before it does.
- These Terms govern your Advisor Account, your Application and your participation in the Program until you sign the Advisor Agreement. Mecavoy membership is charged on the Mecavoy Service under its membership terms, as Section 7.5 describes. Other commercial terms, including other fees and payment terms, are set out in the Advisor Agreement.
- If Mecavoy approves your Application by 11:59 p.m. Eastern Time on January 31, 2027 and you sign the Advisor Agreement, your first year of Mecavoy membership is 50 percent off: US$214.50 for Registered Advisor membership, then US$429 a year, and US$124.50 for Independent Agent membership, then US$249 a year, charged from January 2027. Those full annual prices are the ones in effect at the date of this version. Membership renews automatically each year at the full annual price then in effect unless you cancel, which you can do online at any time, and Mecavoy reminds you about 30 days and about 7 days before each renewal. The first charge and each renewal carry a 14-day money-back guarantee, limited to one refund per person for each type of membership in any 12 months.
- Independent Agents may apply from the countries listed on the Application Form. The Program is not open to anyone who resides in, or applies from, the countries and regions listed in Section 3.3, which include those subject to comprehensive U.S. sanctions. At the date of this version, the Program is not yet open in, among other places, the European Union, the European Economic Area, the United Kingdom and Switzerland. The Registered Advisor Track is open only to individuals who reside in the United States, applying for businesses organized or registered there. You may specialize in destinations anywhere.
- If you reside in California, Florida, Hawaii or Washington, you may apply and be verified now, but you will not be offered Briefs until Mecavoy is registered to sell travel in your state, which it expects by December 2027.
- Mecavoy staff verify each Application before approving it. Verification may include identity, credential, document and reference checks, and a check against U.S. government sanctions lists. Mecavoy does not obtain consumer reports, and it does not obtain criminal or court records about applicants who reside outside the United States. If Mecavoy itself obtains public records about you during verification, it will email you a copy within seven days after obtaining them. Mecavoy may decline any Application without giving reasons.
- Approval does not guarantee any number of Travelers, Briefs or bookings, or any level of earnings.
- You participate as an independent business, not as an employee or agent of Mecavoy. Subject to the location rules in Section 3.8 for applicants outside the United States, you decide how, when and where you work, and you may work with other clients, platforms and host agencies. You are responsible for your own taxes and for complying with the law where you live and work.
- Uploaded documents are stored in encrypted form and are accessible only to authorized Mecavoy staff and service providers. Documents from a declined Application are deleted no later than 12 months after the decision.
- You may withdraw your Application at any time before you sign the Advisor Agreement, in the Advisor Console or by emailing support@mecavoy.com, and you may delete your Advisor Account at any time in the Advisor Console or by emailing support@mecavoy.com or privacy@mecavoy.com.
- If you applied while an earlier version of these Terms was published, that version continues to apply to your Application until you accept this version, which you do when you create an Advisor Account. If you applied under Version 1, any provision of this version that is more favorable to you also applies to you. If you applied under Version 1.2 or an earlier version, or accepted Version 1.2 when you created your Advisor Account, you keep the first year of membership at no charge that the earlier version offered, in place of the 50 percent founding price, even if you later accept this version, and the approval deadline of January 31, 2027 does not apply to that first year.
- These Terms and all communications about the Program are in English.

1. Parties
1.1 Parties. These Founding Advisor Program Terms (these “Terms”) are an agreement between Mecavoy LC, a Wyoming limited liability company (Wyoming entity ID 2026-002066107), 5830 E 2nd St, Ste 7000 #38404, Casper, WY 82609, United States (“Mecavoy”, “we”, “us” or “our”), and the individual who creates an Advisor Account or submits an Application (“you” or “your”).
1.2 Business applicants. If you submit an Application on the Registered Advisor Track for a business, “you” also includes that business, and you represent and warrant that you are authorized to accept these Terms on behalf of that business and to bind it to them.
1.3 Contact. Questions about these Terms or your Application may be sent to support@mecavoy.com, and questions about your personal information to privacy@mecavoy.com. Formal notices must be given as set out in Section 22.
2. Scope, Acceptance and Interpretation
2.1 Scope. These Terms govern your Advisor Account, your Application and your participation in the Program until you and Mecavoy sign the Advisor Agreement, and after that to the extent provided in Section 10.2.
2.2 Acceptance. You accept these Terms by checking the box confirming that you agree to them when you create your Advisor Account, and again by checking the box on the Application Form confirming that you agree to them and submitting your Application. If you do not agree to these Terms, do not create an Advisor Account or submit an Application. Mecavoy records the version of these Terms that you accepted and the date and time of each acceptance, and will provide a copy of that version on request. You may print or save a copy of these Terms for your records.
2.3 Not the Advisor Agreement. These Terms are not the agreement under which you would work with Mecavoy. That agreement is the Advisor Agreement described in Section 10. Nothing in these Terms obliges you or Mecavoy to enter into the Advisor Agreement.
2.4 No fee under these Terms. Mecavoy does not charge any fee to submit an Application or to participate in the Program under these Terms. Mecavoy membership, including the founding price described in Section 7.1(b), is charged on the Mecavoy Service under its membership terms, as Section 7.5 describes.
2.5 Definitions. In these Terms, the following terms have the following meanings:
“Advisor Account” means the account you create at mecavoy.com/advisor/signup to apply to and take part in the Program.
“Advisor Agreement” means the separate written agreement described in Section 10 that governs the commercial relationship between Mecavoy and an advisor whose Application has been approved.

“Application” means an application to join the Program submitted through the Application Form, together with all information and Materials submitted with it or provided to Mecavoy in connection with it.
“Application Form” means the application form published at mecavoy.com/advisor/apply.
“Brief” means a request for travel planning that a Traveler makes through the Mecavoy Service.
“Confidential Information” has the meaning given in Section 11.1.
“Country of Residence” means the country or territory in which you ordinarily reside.
“Feedback” has the meaning given in Section 12.5.

“Independent Agent Track” means the track of the Program for independent travel advisors, including advisors who work with a host agency.
“Materials” means the headshot, documents, profile text, sample itineraries and any other content that you submit or provide in connection with your Application or the Program.
“Mecavoy Service” means the Mecavoy travel planning and booking service, which is scheduled to open to founding advisors for early access in December 2026, and to Travelers across the United States in January 2027.

“Program” means the Mecavoy Founding Advisor Program described in these Terms.
“Registered Advisor Track” means the track of the Program for advisors who operate their own registered travel business in the United States.
“Restricted Party” means a person identified on the Specially Designated Nationals and Blocked Persons List maintained by OFAC or on any other list of restricted parties maintained by the U.S. government, or an entity owned 50 percent or more, directly or indirectly, individually or in the aggregate, by one or more such persons.
“Restricted Territory” has the meaning given in Section 3.3.
“Sanctions Laws” means the economic sanctions laws and regulations of the United States, including those administered by OFAC.
“Traveler” means a user of the Mecavoy Service who plans or books travel through it.
“United States” means the fifty states, the District of Columbia, Puerto Rico, Guam, the U.S. Virgin Islands, American Samoa and the Northern Mariana Islands.
2.6 Interpretation. In these Terms: (a) headings are for convenience only and do not affect interpretation; (b) “including” and similar words mean including without limitation; (c) a reference to a Section is to a section of these Terms; (d) “written” and “in writing” include email; and (e) the summary at the top of this page does not form part of these Terms, and if it conflicts with these Terms, these Terms control.
3. Eligibility
3.1 Requirements. To apply, you must:
- be at least 18 years of age and, if the age of majority where you reside is higher than 18, have reached that age;
- have the legal capacity to enter into a binding agreement and, on the Registered Advisor Track, the authority to bind the business for which you apply;
- meet the residence requirements in Sections 3.2 to 3.4 for the track on which you apply;
- meet the requirements of Section 3.5;
- provide information that is true, accurate, current and complete; and
- on the Registered Advisor Track, operate a lawfully registered travel business that holds every seller-of-travel registration and license required by the law of each state in which it sells travel or to whose residents it sells travel, and any other registration, license or bond that the law requires for the travel it sells.
3.2 Residence. You may apply only on a track whose residence requirements you meet:
- Independent Agent Track. You may apply on the Independent Agent Track if your Country of Residence is a country or territory listed on the Application Form, subject to Sections 3.3 and 3.4.
- Registered Advisor Track. You may apply on the Registered Advisor Track only if you reside in the United States and the business for which you apply is organized under the law of, or registered to do business in, a jurisdiction within the United States.
- Destinations. This Section 3.2 concerns only where you reside and, on the Registered Advisor Track, where your business is organized or registered. It does not limit the destinations in which you may specialize or for which you may plan travel, subject to Section 8.2(f).
3.3 Restricted Territories. The Program is not open to anyone who resides in a Restricted Territory or who submits an Application from one. “Restricted Territory” means each of the following:
- Cuba, Iran and North Korea;
- the Crimea region of Ukraine, including the city of Sevastopol, and the so-called Donetsk People’s Republic and Luhansk People’s Republic regions of Ukraine;
- Russia, Belarus, Syria and mainland China, which does not include Hong Kong, Macao or Taiwan; and
- any other country or region that becomes subject to comprehensive sanctions under the Sanctions Laws, or in which Mecavoy determines that applicable law does not permit it to engage or pay you.
The places in item (c) are Restricted Territories as a business decision by Mecavoy, based on its own assessment of risk, not to offer the Program there.
Mecavoy may update this Section 3.3 when the Sanctions Laws change. Section 17.2 does not prevent an update that the Sanctions Laws require from applying to you from the date on which it is published.
3.4 Places where the Program is not yet open. On the Independent Agent Track, the Program is open only to individuals who reside in a country or territory listed on the Application Form when they submit their Application and, where the Application Form lists the states, provinces or regions of that country, in one of those listed. The Program is not yet open in some countries and regions that are not Restricted Territories. At the date of this version, the Program is not yet open in, among other places, the member states of the European Union and the European Economic Area, the United Kingdom and Switzerland. Mecavoy may add countries, territories and regions to the Application Form at any time. If your Country of Residence changes to a country, territory or region that is not listed on the Application Form, Mecavoy may pause its review of your Application, or your participation in the Program, until it is listed.
3.5 Sanctions. You represent and warrant that:
- you do not ordinarily reside in a Restricted Territory, you did not submit your Application from one, and you will not perform services under the Program while you are in one;
- you are not a Restricted Party and are not acting for or on behalf of a Restricted Party; and
- you are not otherwise a person with whom the Sanctions Laws prohibit a United States person, as that term is defined in the Sanctions Laws, from dealing.
You must notify Mecavoy promptly if any of these statements ceases to be true. Before approving your Application, Mecavoy checks your name and Country of Residence and, on the Registered Advisor Track, the name of your business, against the Specially Designated Nationals and Blocked Persons List and such other U.S. government restricted-party lists as Mecavoy selects. Mecavoy may repeat that check at any time while your Application is under review or you participate in the Program.
3.6 Registrations and licenses. You must hold every registration, license, bond, trust account or other authorization that the law of your Country of Residence, of any other place in which you do business, or of any place to whose residents you sell, arrange or advise on travel, requires of you for the services you provide. Some U.S. states, including California, Florida, Hawaii and Washington, have seller-of-travel laws that may apply to a person who sells, arranges or advises on travel for their residents even if that person is located in another state or country. You are responsible for determining which of these requirements apply to you. On the Registered Advisor Track, your business must hold each of them to meet Section 3.1(f).
3.7 Independent Agent Track. You may apply on the Independent Agent Track whether you work on your own or with a host agency. Business registration documents are not required to apply on that track.
3.8 Applicants outside the United States. If your Country of Residence is not the United States:
- you are responsible for complying with the laws of your Country of Residence and of any other place in which you perform services, including laws on business registration, licensing, taxes and social contributions; and
- you must perform your services from outside the United States unless you are authorized to work in the United States, and you must notify Mecavoy before you perform any services while you are in the United States.
3.9 Applicants in California, Florida, Hawaii and Washington. If you reside in California, Florida, Hawaii or Washington, you may apply, and Mecavoy may verify and approve your Application, but Mecavoy will not offer you Briefs through the Mecavoy Service until Mecavoy is registered to sell travel in your state, which it expects by December 2027. Mecavoy will email you when it begins to offer Briefs to advisors in your state.
4. Applications and Advisor Accounts
4.1 Accuracy. You represent and warrant that all information in your Application is true, accurate, current and complete and is not misleading. If any material information changes while your Application is under review or you participate in the Program, including your contact details, your Country of Residence, your business or a registration, you must notify Mecavoy promptly at support@mecavoy.com.
4.2 Authentic documents. You represent and warrant that each document you upload is genuine and unaltered and relates to you or your business, and that your headshot is a clear, recent photograph of you.
4.3 Rights in Materials. You represent and warrant that you have all rights, consents and permissions necessary to submit your Materials and to grant the license in Section 12. Your Materials must not include personal information about a client or any other individual unless you have the right to share it with Mecavoy for the purposes described in Section 12.2. For example, a sample itinerary must not identify a client unless that client has agreed.
4.4 Additional information. Mecavoy may ask you for additional information or documents, or for a call, before completing its review. If you do not provide them, Mecavoy may be unable to continue its review and may decline your Application.
4.5 One active Application. You may have only one Application under review or approved at a time, submitted in your own name through your own Advisor Account. An Application submitted before Advisor Accounts were available is linked to the Advisor Account that uses the same confirmed email address. To change information in a submitted Application, email support@mecavoy.com.
4.6 Advisor Account. The following provisions apply to your Advisor Account:
- Account required. To submit an Application, you must have an Advisor Account with a confirmed email address and be signed in to it. You confirm your email address by entering the six-digit code that Mecavoy sends to it. The email address of your Advisor Account is the email address of your Application.
- One account, in your own name. You may hold only one Advisor Account. It is personal to you: you must use your own name, keep the information in it true, accurate and current, and not share it, transfer it or let anyone else use it.
- Security. You are responsible for keeping your password confidential and, if you turn on two-step sign-in, for keeping secure your recovery codes and the authenticator app that generates your sign-in codes. You are responsible for activity in your Advisor Account. You must tell Mecavoy promptly at support@mecavoy.com if you believe that someone else has used your Advisor Account or knows your password or recovery codes. If you lose both your authenticator app and your recovery codes, Mecavoy may, at your request and after confirming that the request comes from the email address of your Advisor Account, turn off two-step sign-in, and you will then need to choose a new password using a link sent to that address.
- Suspension and closure. Mecavoy may suspend your Advisor Account, sign it out of every browser or require you to choose a new password if it reasonably believes this is necessary to protect you, other users or Mecavoy, including where it suspects that someone else has used your Advisor Account. Mecavoy may also suspend or close your Advisor Account as provided in Section 16.2. While your Advisor Account is suspended, you cannot sign in to it, and you may contact support@mecavoy.com. Suspension does not by itself withdraw or decline your Application.
- Account emails. Mecavoy sends the account and security emails described in Section 14.2 to the email address of your Advisor Account. They are part of the service, and you cannot opt out of them while you have an Advisor Account.
- Changing your email address. To change the email address of your Advisor Account, email support@mecavoy.com or privacy@mecavoy.com. Mecavoy may ask you to confirm the request from both the current and the new address before it makes the change, and will tell both addresses when the change is made.
- Who may hold an Advisor Account. You may create an Advisor Account only if you are at least 18 years of age and, if the age of majority where you reside is higher than 18, have reached that age, and only if you reside in a country or territory listed on the Application Form. You may not create an Advisor Account if you reside in a Restricted Territory or while you are in one, and Mecavoy may refuse to create an Advisor Account when the request appears to come from a Restricted Territory. If your Country of Residence later changes to a country, territory or region that is not listed on the Application Form, Section 3.4 applies, and if it changes to, or becomes, a Restricted Territory, Section 3.3 applies. Mecavoy asks for your country of residence when you create an Advisor Account and checks it, but does not keep it on its systems; Section 5.2 of the Privacy Policy describes the copy kept in your browser. Holding an Advisor Account does not mean that you are eligible to apply; Section 3 sets out who may apply, and Mecavoy checks it when you submit an Application.
4.7 Applying again. You may submit a new Application in the Advisor Console, subject to the following:
- After a withdrawal. If you withdraw your Application, you may submit a new Application at any time.
- After a decline. If Mecavoy declines your Application, you may submit a new Application no sooner than 180 days after the date of the decision, unless Mecavoy allows you to apply sooner.
- Limit. You may submit no more than three (3) Applications in any period of 12 months. Every Application you submit counts toward this limit, including one that you later withdraw. To apply this limit, Mecavoy keeps a record of when you submitted each Application for at least 12 months, even after the Application is withdrawn or deleted, as described in Sections 3.11 and 3.13 of the Privacy Policy.
- New Applications. A new Application is governed by the version of these Terms in effect when you submit it and is reviewed afresh. Mecavoy may take into account the information about your earlier Applications that it keeps under Section 13.3.
- Deleting your Advisor Account. Deleting your Advisor Account and creating another does not change when you may apply again under this Section 4.7. Section 3.13 of the Privacy Policy describes the limited record that Mecavoy keeps for this purpose.
- Exceptions. You may not submit a new Application while your Advisor Account is suspended, or while applicable law requires Mecavoy to keep records of an earlier Application of yours, even if paragraph (a) or (b) would otherwise allow it. In those cases, you may contact support@mecavoy.com.
4.8 Moving your Advisor Account to the Mecavoy Service. When Mecavoy moves Advisor Accounts to the Mecavoy Service:
- Mecavoy intends to move your Advisor Account and your Application to the Mecavoy Service, so that you can sign in there with the same email address and, unless you must first choose a new password, the same password. What moves includes your name, your email address, a one-way hash of your password (or, if you must choose a new password when the move happens, a record that you must do so), the status of your Advisor Account, the dates on which you submitted Applications in the previous 12 months and any date from which you may apply again, so that Section 4.7 continues to apply. Section 3.14 of the Privacy Policy lists what moves.
- Mecavoy will not move the secret shared with your authenticator app or your recovery codes. If you use two-step sign-in, you will set it up again when you first sign in to the Mecavoy Service, and the email described in paragraph (c) will tell you so.
- Mecavoy will email you at least 30 days before the move, and you may delete your Advisor Account before then.
- Your use of the Mecavoy Service is governed by the terms presented to you when you first sign in to it. These Terms continue to govern your Application and your participation in the Program until you sign the Advisor Agreement.
5. Verification
5.1 Checks. Mecavoy will verify each Application before approving it. Verification is carried out by Mecavoy staff and may include:
- identity checks, which may include a video call with you during which you show Mecavoy an official photo identity document;
- credential and document checks, including confirming a certificate, registration or license with the body that issued it or with a public register;
- reference checks, by contacting any references you give Mecavoy;
- a review of samples of your past work that you provide;
- a review of the website and social media profiles listed in your Application and of publicly available information about your travel business; and
- screening of your name and Country of Residence and, on the Registered Advisor Track, the name of your business, against the lists described in Section 3.5.
5.2 Authorization. By checking the verification box on the Application Form and submitting your Application, you authorize Mecavoy to carry out the checks described in Section 5.1 and, for that purpose, to contact the issuing bodies, public registers and references referred to in that Section, to share with them the information reasonably necessary to complete each check, and to receive from them information about you and your business.
5.3 No consumer reports. Mecavoy does not obtain consumer reports or investigative consumer reports, as those terms are defined in the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.), from consumer reporting agencies in connection with Applications. If Mecavoy decides in the future to obtain a consumer report about you, Mecavoy will first provide you with any disclosure, and obtain from you any authorization, that applicable law requires.
5.4 Copies of public records. If Mecavoy itself obtains public records about you in the course of verifying your Application, Mecavoy will send a copy of those records to the email address in your Application within seven (7) days after it obtains them. You do not need to request the copy.
5.5 Applicants outside the United States. If your Country of Residence is not the United States, Mecavoy verifies your Application using only the checks described in Section 5.1. In doing so, Mecavoy does not search public records about you, other than to confirm, with the body that issued it or with a public register, a certificate, registration or license that you have submitted, and to carry out the screening described in Section 5.1(f), and Mecavoy does not obtain criminal records, court records or consumer reports about you.
5.6 Identity documents. Mecavoy uses any identity document you show it only to confirm your identity and your eligibility under Section 3. Mecavoy does not record the video call or keep an image or copy of the document unless you agree or the law requires it, and it does not use facial recognition or other automated means to compare your headshot with the document.
6. Decisions and No Guarantee
6.1 Decisions. Mecavoy may approve or decline any Application in its sole discretion and is not required to give reasons for its decision. Mecavoy will not decline an Application because of any characteristic protected by applicable law, except where the Sanctions Laws require it. Mecavoy will notify you of its decision by email.
6.2 No guarantee of approval. Submitting an Application does not guarantee approval or a place in the founding cohort of the Program.
6.3 No guarantee of business. Approval does not guarantee any number of Travelers, Briefs or bookings, or any level of earnings.
6.4 The Mecavoy Service. The Mecavoy Service is new. It is scheduled to open to founding advisors for early access in December 2026, and to Travelers across the United States in January 2027. The timing of each opening, and the features available at each, may change.
6.5 Meaning of approval. Approval of your Application means only that Mecavoy has accepted you into the Program. Approval, verification and the Founding Advisor badge are not a license, certification or endorsement of you or your business by Mecavoy, and you must not describe them as one.
7. Founding Advisor Benefits
7.1 Benefits. If Mecavoy approves your Application within the time stated in Section 7.2 and you sign the Advisor Agreement, Mecavoy will provide you with the following benefits:
- a Founding Advisor badge, displayed on your advisor profile on the Mecavoy Service for as long as you remain in Good Standing;
- 50 percent off your first year of Mecavoy membership, as described in Section 7.5, which is US$214.50 for Registered Advisor membership (then US$429 a year, with invoicing tools included and no invoicing fee) and US$124.50 for Independent Agent membership (then US$249 a year, with Independent Agent membership charged from January 2027);
- individually selected first Briefs, meaning that the first Briefs offered to you are selected for you individually; and
- a direct line to Mecavoy, through which you may raise questions and give Feedback.
7.2 Conditions. Places in the founding cohort are limited to applicants on either track whose Applications Mecavoy approves by 11:59 p.m. Eastern Time on January 31, 2027. The individual selection described in Section 7.1(c) concerns only how the first Briefs offered to you are selected. It is not a commitment to offer you any number of Briefs, and Section 6.3 continues to apply.
7.3 Personal benefits. The Founding Advisor Benefits are personal to you. They may not be transferred, sold or exchanged, and they have no cash value.
7.4 Withdrawal of benefits. Mecavoy may withdraw a Founding Advisor Benefit only as provided in Section 16 or in the Advisor Agreement.
7.5 Founding price, automatic renewal and money-back guarantee. Mecavoy membership, including the founding price in Section 7.1(b), is provided and charged under the membership terms presented to you on the Mecavoy Service when your membership starts, and not under these Terms. Those membership terms will be consistent with the following:
- When you are charged. Your membership fee is charged on the Mecavoy Service when your membership starts there, and never when you create an Advisor Account or submit an Application. Independent Agent membership is not charged before January 2027. Membership fees are paid by card, including by Independent Agents who reside outside the United States.
- Which price applies. The price that applies to you is the one for the membership that matches the track on which Mecavoy approves your Application, which may differ from the track on which you applied.
- First year. Your first year of membership is the 12 months that begin on the date of your first membership charge.
- Automatic renewal. After your first year, your membership renews automatically for one year at a time, at the full annual price for your membership in effect on the renewal date, until you cancel it. At the date of this version, that price is US$429 a year for Registered Advisor membership and US$249 a year for Independent Agent membership. Before your first membership charge, Mecavoy will show you the renewal price and the renewal date, and will ask for your consent to automatic renewal separately, with a box that is not checked in advance. Accepting these Terms is not consent to automatic renewal.
- Reminders. Mecavoy will email you about 30 days, and again about 7 days, before each renewal, stating the renewal date, the price and how to cancel.
- Cancellation. You may cancel your membership online at any time. Canceling stops the next renewal. Unless you receive a refund under paragraph (g), your membership then continues until the end of the year you have paid for, and the fee for that year is not refunded, except where the law requires a refund.
- Money-back guarantee. Your first membership charge and each renewal charge carry a 14-day money-back guarantee. If you ask Mecavoy for a refund, online or by emailing support@mecavoy.com, within 14 days after the charge, Mecavoy will refund that charge in full to the original payment method, without asking for a reason, and your membership ends when the refund is made. The guarantee is limited to one refund per person for each type of membership in any period of 12 months.
- What the guarantee covers. The guarantee covers membership fees only. Other fees, and bookings, are governed by their own terms.
8. Expectations and Standards of Conduct
8.1 Expectations. Mecavoy expects each founding advisor to:
- complete an advisor profile, with a clear, recent headshot and the advisor’s specialties;
- publish signature itineraries, as set out in the Advisor Agreement; and
- respond to Briefs matched to the advisor within the time stated in the Advisor Agreement.
These expectations become binding obligations only to the extent set out in the Advisor Agreement.
8.2 Standards of conduct. While your Application is under review and while you participate in the Program, you must:
- act professionally and courteously toward Travelers, other advisors and Mecavoy;
- deal honestly with Travelers, including by giving accurate advice, being clear about the services you will and will not provide, and respecting their budgets;
- not unlawfully discriminate against any Traveler on the basis of race, color, religion, sex, sexual orientation, gender identity, national origin, disability, age or any other characteristic protected by applicable law;
- comply with all laws that apply to the sale of travel, including consumer protection laws and the registration requirements described in Section 3.6;
- comply with all anti-corruption laws that apply to you, and not offer, give, request or accept any bribe or other improper payment, including to or from a government official, in connection with the Program; and
- comply with the Sanctions Laws and the other laws that apply to you, and not plan, arrange or promote travel that those laws prohibit for the Traveler concerned.
9. Independent Status
9.1 Relationship. You apply to and participate in the Program as an independent business. Nothing in these Terms or the Program creates an employment, partnership, joint venture, agency or franchise relationship between you and Mecavoy. You have no authority to bind Mecavoy or to make any representation or commitment on its behalf, and you are not entitled to any employee benefits from Mecavoy. The name “Independent Agent Track” follows travel-industry usage for independent travel advisors. It does not make you an agent of Mecavoy, and this Section 9 applies on both tracks.
9.2 Control of your services. You decide how, when and where you perform your services, including your working hours, your location (subject to Section 3.8(b)) and your methods. Mecavoy does not train you in how to perform your services, supervise your work or set your schedule. Any onboarding assistance that Mecavoy provides, such as help setting up your advisor profile, concerns only your use of the Mecavoy Service. Any standard in these Terms or the Advisor Agreement, such as the time within which you respond to a Brief, concerns the results of your services and not the manner in which you perform them.
9.3 Tools, expenses, taxes and licenses. You provide your own tools and equipment, other than access to the Mecavoy Service, and you bear your own business expenses. You are solely responsible for your own taxes, for any social security or similar contributions, for any value added, goods and services or similar taxes on your services, and for your business registrations, licenses and insurance. Before Mecavoy makes any payment to you under the Advisor Agreement, you must give Mecavoy the tax form that applies to you, such as IRS Form W-9 if you are a U.S. person for U.S. federal tax purposes or IRS Form W-8BEN if you are an individual who is not, and you must keep it current. Mecavoy may withhold from any payment, and report, any amount that the law requires.
9.4 No exclusivity. Your participation in the Program is not exclusive. You may provide services to other clients and work with other platforms and host agencies, and these Terms do not require you to stop working with a host agency. You represent and warrant that applying to and participating in the Program do not breach any agreement between you and a host agency or any other third party, and you are responsible for reviewing any such agreement for restrictions.
9.5 Advisor Agreement. After you sign the Advisor Agreement, it governs your relationship with Mecavoy as provided in Section 10.2, and this Section 9 continues to apply to the extent that the Advisor Agreement does not address the same subject matter.
10. The Advisor Agreement
10.1 Commercial terms. The commercial terms of working with Mecavoy, including fees other than membership fees, payment terms and each party’s responsibilities, are set out in the Advisor Agreement and not in these Terms. Mecavoy membership fees, including the founding price described in Section 7.1(b), are charged under the membership terms of the Mecavoy Service, as Section 7.5 describes. If your Application is approved, Mecavoy will provide the Advisor Agreement to you and give you a reasonable opportunity to review it before you decide whether to sign it. You are under no obligation to sign it.
10.2 Effect of the Advisor Agreement. Once you and Mecavoy have signed the Advisor Agreement, it governs the relationship between you and Mecavoy. If the Advisor Agreement conflicts with these Terms, the Advisor Agreement controls. Section 7 and the provisions of these Terms listed in Section 21.7 continue to apply to the extent that the Advisor Agreement does not address the same subject matter.
11. Confidentiality
11.1 Confidential Information. “Confidential Information” means non-public information that Mecavoy discloses to you in connection with your Application or the Program, including previews of the Mecavoy Service and of unreleased features, draft documents (including drafts of the Advisor Agreement) and non-public information about the Program, whether disclosed in writing, orally or by demonstration, that is marked as confidential or that a reasonable person would understand to be confidential.
11.2 Obligations. You must (a) use Confidential Information only to evaluate and participate in the Program; (b) not disclose Confidential Information to anyone without Mecavoy’s prior written consent; and (c) protect Confidential Information with at least reasonable care.
11.3 Exclusions. Confidential Information does not include information that:
- is or becomes publicly available other than through a breach of these Terms by you;
- you lawfully knew before Mecavoy disclosed it to you, without a duty of confidentiality;
- you lawfully receive from a third party without a duty of confidentiality; or
- you develop independently without use of Confidential Information.
11.4 Disclosure required by law. You may disclose Confidential Information to the extent required by law or by order of a court or government authority, provided that, where legally permitted, you give Mecavoy prompt notice of the requirement and reasonable cooperation if Mecavoy seeks a protective order or other remedy.
11.5 Duration. Your obligations under this Section 11 continue while your Application is under review and while you participate in the Program, and for three (3) years after the later of the end of your participation and the withdrawal or decline of your Application. For any Confidential Information that is a trade secret, they continue for as long as it remains a trade secret under applicable law.
11.6 Permitted statements and protected activity. Nothing in these Terms prevents you from (a) stating that you have applied to the Program or that you are a founding advisor; (b) reporting a possible violation of law to, filing a charge or complaint with, or communicating with any government agency; or (c) making any other disclosure protected by law.
11.7 Defend Trade Secrets Act notice. Under 18 U.S.C. § 1833(b), an individual will not be held criminally or civilly liable under any federal or state trade secret law for the disclosure of a trade secret that (a) is made in confidence to a federal, state or local government official, either directly or indirectly, or to an attorney, solely for the purpose of reporting or investigating a suspected violation of law; or (b) is made in a complaint or other document filed in a lawsuit or other proceeding, if that filing is made under seal. An individual who files a lawsuit for retaliation by an employer for reporting a suspected violation of law may disclose the trade secret to the individual’s attorney and use the trade secret information in the court proceeding, if the individual files any document containing the trade secret under seal and does not disclose the trade secret, except pursuant to court order.
12. Materials, License and Feedback
12.1 Ownership. As between you and Mecavoy, you retain all ownership rights in your Materials.
12.2 License. You grant Mecavoy a non-exclusive, worldwide, royalty-free license to host, store, copy, format (including by resizing or cropping images) and use your Materials solely:
- to receive, review and verify your Application;
- to communicate with you about your Application and the Program;
- if your Application is approved and you sign the Advisor Agreement, to prepare your advisor profile; and
- to keep records as required by law or as described in the Privacy Policy.
Mecavoy may sublicense these rights only to its service providers, and only to the extent necessary for them to act on Mecavoy’s behalf for those purposes.
12.3 No publication. Mecavoy will not publish your Materials, name or likeness, on the Mecavoy Service or elsewhere, except as permitted by the Advisor Agreement or with your separate consent.
12.4 End of the license. If your Application is declined or withdrawn, the license in Section 12.2 ends, except that Mecavoy may continue to store your Materials for the retention periods described in Section 13 and the Privacy Policy.
12.5 Feedback. You are not required to give Mecavoy any suggestions, comments or other feedback about the Mecavoy Service or the Program (“Feedback”). If you do, you grant Mecavoy a perpetual, irrevocable, worldwide, royalty-free, fully paid-up license, with the right to sublicense, to use the Feedback for any purpose, without obligation to you. Feedback does not include your Materials.
13. Personal Information
13.1 Privacy Policy. Mecavoy handles personal information in your Advisor Account and your Application as described in the Privacy Policy, in particular its section on founding advisor applications and Advisor Accounts.
13.2 Security. Documents you upload are transmitted over an encrypted connection, stored in encrypted form and not publicly accessible. Access to Applications is limited to authorized Mecavoy staff who review Applications and to Mecavoy’s service providers acting on its behalf. Mecavoy does not sell your personal information or share it with anyone for their own marketing.
13.3 Retention. Subject to Section 13.4:
- if your Application is approved, Mecavoy keeps it for as long as you are a Mecavoy advisor, and afterwards for as long as the Advisor Agreement or applicable law requires;
- if your Application is declined, Mecavoy deletes the documents you uploaded no later than 12 months after the date of its decision, and keeps the rest of the Application only for as long as reasonably necessary to answer questions about the decision, to consider a future Application from you, to comply with its legal obligations and to establish, exercise or defend legal claims;
- if you withdraw your Application in the Advisor Console, Mecavoy deletes the documents uploaded with it promptly and the rest of the Application within 30 days; if you withdraw your Application by email, or ask Mecavoy to delete it, Mecavoy deletes the Application and the documents uploaded with it within 30 days after receiving your request; and if you delete your Advisor Account, or Mecavoy closes it under Section 16.2, Mecavoy deletes your Application and the documents uploaded with it when it deletes your Advisor Account; in each case subject to item (e) and except to the extent the Advisor Agreement or applicable law requires Mecavoy to keep them;
- files uploaded through the Application Form but not submitted with a completed Application are deleted automatically three days after upload, although the deletion can take a few more days to complete; and
- records of the screening described in Section 3.5 are kept with your Application for the periods described in this Section 13.3 and, if you sign the Advisor Agreement, for at least ten (10) years after Mecavoy’s last transaction with you, or for any longer period that the law requires. If that screening confirms that you are a Restricted Party, Mecavoy keeps the screening records, and the information in your Application needed to identify you and to show what was screened and decided, for ten (10) years after that confirmation or for any longer period that the Sanctions Laws require, even if you withdraw your Application, your Advisor Account is deleted or closed, or you ask Mecavoy to delete your Application. The documents you uploaded, and the rest of your Application, are deleted as this Section 13.3 otherwise provides.
13.4 Backups. Deleted documents may remain in the version history of Mecavoy’s storage provider for up to 30 days, and deleted records may remain in encrypted backups for up to 35 days, before they are permanently removed.
13.5 Your rights. You may ask to access, correct, delete or obtain a copy of the personal information Mecavoy holds about you, and you may withdraw your consent to advisor news at any time, by emailing privacy@mecavoy.com. You may also view the status of your Application, withdraw it and delete your Advisor Account in the Advisor Console. The Privacy Policy describes these rights in full.
14. Electronic Communications
14.1 Consent to electronic communications. You agree that Mecavoy may provide notices, agreements, disclosures and other communications relating to your Application and the Program electronically, including by email to the address in your Application, and that those communications satisfy any legal requirement that they be in writing. You agree that checking a box when you create your Advisor Account or on the Application Form, and creating your Advisor Account or submitting your Application, constitutes your electronic signature and your agreement to these Terms.
14.2 Application and account emails. Mecavoy will email you to confirm receipt of your Application, to request any further information, to notify you of its decision and, if Section 3.9 applies to you, to tell you when it begins to offer Briefs to advisors in your state. Mecavoy will also email you, at the email address of your Advisor Account, the codes that confirm your email address and that turn on two-step sign-in, password reset links, and notices of: an attempt to create an Advisor Account with an email address that already has one; sign-ins from a browser not used with your Advisor Account before; wrong two-step sign-in codes entered after your password; changes to your password or to two-step sign-in, including new recovery codes and the use of a recovery code; the withdrawal of your Application; the deletion of your Advisor Account; and certain changes that Mecavoy support makes at your request, such as a change to your sign-in email address. These emails are part of the application process and of your Advisor Account, and are sent regardless of your marketing choices.
14.3 Advisor news. If you check the optional box on the Application Form, Mecavoy may also send you occasional Mecavoy news for advisors. You may stop these emails at any time by replying to any of them or by emailing support@mecavoy.com or privacy@mecavoy.com. Stopping them does not affect your Application.
14.4 Your email address. You must keep the email address of your Advisor Account or, if you do not have one, the email address in your Application, current. To change it, email support@mecavoy.com or privacy@mecavoy.com.
15. Withdrawal of an Application
You may withdraw your Application at any time before you sign the Advisor Agreement, in the Advisor Console, which asks for your password, or by emailing support@mecavoy.com from the email address of your Advisor Account or, if you do not have one, from the email address in your Application. Mecavoy will confirm the withdrawal by email, stop reviewing the Application and delete it as described in Section 13.3(c). A withdrawal cannot be undone, but you may apply again as described in Section 4.7. If your Application has been approved, withdrawing it ends your participation in the Program and releases your place in the founding cohort. After you sign the Advisor Agreement, Section 16.4 applies instead.
16. Termination
16.1 By you. You may leave the Program at any time by notifying Mecavoy at support@mecavoy.com. You may also delete your Advisor Account at any time, in the Advisor Console, which asks for your password, or by emailing support@mecavoy.com or privacy@mecavoy.com from the email address of your Advisor Account. Deleting your Advisor Account cannot be undone. It withdraws and deletes any Application, as described in Section 13.3(c) and subject to Section 13.3(e), and, subject to Section 16.4, ends your participation in the Program.
16.2 By Mecavoy. Mecavoy may decline your Application, withdraw its approval of your Application, suspend or close your Advisor Account, end your participation in the Program or withdraw any Founding Advisor Benefit, by notice to you, if Mecavoy reasonably determines that you:
- provided false, inaccurate or misleading information or documents;
- do not meet, or no longer meet, the eligibility requirements in Section 3;
- have materially breached these Terms, including Section 4, Section 8.2 or Section 11; or
- have acted in a way that exposes Travelers, other advisors or Mecavoy to a risk of harm.
16.3 Opportunity to remedy. Where reasonably practicable, and where the matter can be remedied, Mecavoy will first notify you of the matter and give you a reasonable opportunity to remedy it. This Section 16.3 does not apply where the Sanctions Laws or other applicable law require Mecavoy to act without delay.
16.4 Advisor Agreement. After you sign the Advisor Agreement, termination of your relationship with Mecavoy is governed by the Advisor Agreement.
17. Changes to the Program and These Terms
17.1 Changes to the Program. Subject to Section 7.4, Mecavoy may modify, suspend or discontinue the Program, or close it to new Applications, at any time. Closing the Program to new Applications does not affect advisors whose Applications Mecavoy has already approved. If Mecavoy discontinues the Program, it will notify applicants and approved advisors by email, and Mecavoy is not required to provide or enter into the Advisor Agreement with anyone who has not signed it by the date of that notice.
17.2 Changes to these Terms. Mecavoy may publish updated versions of these Terms on this page, each with a new version number and effective date. The version in effect when you submit your Application applies to that Application. A later version applies to you only if you accept it, either when Mecavoy asks you to do so, which Mecavoy will do by email, or, as Section 17.4 provides, when you create an Advisor Account. If you do not accept a later version, the version you accepted continues to apply to you.
17.3 Applications submitted under Version 1. This Section 17.3 applies to you if you submitted your Application while Version 1 of these Terms was the version published on this page. Version 1 continues to apply to your Application, and you keep every right that Version 1 gave you, unless you accept this version as Section 17.2 provides. Where a provision of this version is more favorable to you than the corresponding provision of Version 1, Mecavoy will apply that provision to your Application. A copy of Version 1 is available on request from support@mecavoy.com.
17.4 Applications submitted before Advisor Accounts. This Section 17.4 applies to you if you submitted your Application before Advisor Accounts were available:
- you do not need an Advisor Account for Mecavoy to complete its review of your Application, and you may withdraw it by email as Section 15 provides;
- if you create an Advisor Account with the email address in your Application, Mecavoy links your Application to that Advisor Account as Section 4.5 provides, and you may then view the status of your Application and withdraw it in the Advisor Console; and
- you accept this version of these Terms when you create an Advisor Account. That acceptance is an acceptance of this version for the purposes of Sections 17.2 and 17.3, and from then on this version applies to your Application, except that Section 17.5 applies to the Founding Advisor Benefit in Section 7.1(b). When Mecavoy links your Application to your Advisor Account, it records with your Application the version you accepted and the date and time you accepted it, as Section 2.2 provides.
17.5 Earlier founding benefit. This Section 17.5 applies to you if you submitted an Application under Version 1.2 or an earlier version of these Terms, or if you accepted Version 1.2 when you created your Advisor Account. Whichever version of these Terms applies to you, including this version if you accept it later, for example by submitting a new Application or under Section 17.4(c), Section 7.1(b) of this version does not apply to you. In its place, you keep the Founding Advisor Benefit set out in Section 7.1(b) of the earlier version that applied to you, which is your first year of Mecavoy advisor membership at no charge, on the terms, including the start date, set out in the Advisor Agreement. The time stated in Section 7.2 does not apply to that first year. Section 7.5 does not apply to that first year, and applies to any membership charged after it.
18. Disclaimers and Limitation of Liability
18.1 DISCLAIMER OF WARRANTIES. THE PROGRAM, THE APPLICATION PROCESS, YOUR ADVISOR ACCOUNT, THE ADVISOR CONSOLE AND ANY PREVIEW OF THE MECAVOY SERVICE OR OTHER INFORMATION THAT MECAVOY PROVIDES UNDER THESE TERMS ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MECAVOY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY THAT YOUR APPLICATION WILL BE APPROVED OR THAT YOU WILL RECEIVE ANY BRIEFS, BOOKINGS OR EARNINGS.
18.2 EXCLUSION OF CERTAIN DAMAGES. EXCEPT AS PROVIDED IN SECTION 18.4, AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEITHER PARTY WILL BE LIABLE TO THE OTHER FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL OR OPPORTUNITY, ARISING OUT OF OR RELATING TO THESE TERMS, YOUR APPLICATION, ANY DECISION ON YOUR APPLICATION OR THE PROGRAM, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, EVEN IF THAT PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF THOSE DAMAGES.
18.3 LIMITATION OF LIABILITY. EXCEPT AS PROVIDED IN SECTION 18.4, AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EACH PARTY’S TOTAL AGGREGATE LIABILITY TO THE OTHER ARISING OUT OF OR RELATING TO THESE TERMS, YOUR APPLICATION OR THE PROGRAM WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US$100) AND (B) THE TOTAL FEES THAT YOU PAID TO MECAVOY UNDER THESE TERMS, OR FOR MECAVOY MEMBERSHIP, IN THE TWELVE (12) MONTHS BEFORE THE DATE ON WHICH THE CLAIM AROSE.
18.4 EXCEPTIONS. SECTIONS 18.2 AND 18.3 DO NOT APPLY TO: (A) A PARTY’S OBLIGATIONS TO DEFEND AND INDEMNIFY AGAINST THIRD-PARTY CLAIMS UNDER THESE TERMS, INCLUDING UNDER SECTION 19; (B) LIABILITY ARISING FROM A PARTY’S FRAUD, GROSS NEGLIGENCE OR WILLFUL MISCONDUCT; (C) LIABILITY FOR A BREACH OF SECTION 11 (CONFIDENTIALITY); OR (D) ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
18.5 Jurisdictions. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the exclusions and limitations in this Section 18 may not apply to you.
18.6 Basis of these Terms. Each party acknowledges that Mecavoy charges no fee under these Terms, that Mecavoy membership fees are charged under the membership terms of the Mecavoy Service, as Section 7.5 describes, and that the exclusions and limitations in this Section 18 are an essential basis of these Terms.
19. Indemnification
19.1 Indemnity. You will defend, indemnify and hold harmless Mecavoy and its members, managers, officers, employees and agents from and against any claim by a third party, and any resulting losses, liabilities, damages, costs and expenses (including reasonable attorneys’ fees), to the extent arising out of:
- any inaccuracy in, or breach of, the representations and warranties you give in Section 4;
- any claim that your Materials, or Mecavoy’s use of them in accordance with these Terms, infringe or violate the rights of any third party; or
- your breach of Section 8.2.
19.2 Procedure. Mecavoy will notify you promptly of any claim for which it seeks indemnification, give you reasonable cooperation at your expense, and allow you to control the defense and settlement of the claim, except that you may not settle a claim in a way that imposes any obligation or admission on Mecavoy without Mecavoy’s prior written consent. A delay in notice relieves you of your obligations under this Section 19 only to the extent that the delay prejudices your defense. Mecavoy may participate in the defense with counsel of its choice at its own expense.
20. Governing Law and Disputes
20.1 Governing law. These Terms, and any dispute arising out of or relating to them, your Application or the Program, are governed by the laws of the State of Wyoming and the applicable federal laws of the United States, without regard to conflict-of-laws rules that would require the application of the law of another jurisdiction.
20.2 Venue. Subject to Section 20.3, any action arising out of or relating to these Terms, your Application or the Program must be brought exclusively in the state or federal courts located in Wyoming. You and Mecavoy each consent to the personal jurisdiction of those courts and waive any objection to venue in them.
20.3 Small claims. Section 20.2 does not prevent either party from bringing an individual claim in a small claims court in the United States that has jurisdiction over the claim. If you reside in the United States, you may bring such a claim in the small claims court for the county in which you reside or, if you applied for a business, the county in which that business has its principal place of business, and Mecavoy consents to the personal jurisdiction of that court for that claim.
20.4 Mandatory protections. Nothing in this Section 20 deprives you of any protection under the laws of the state or country in which you reside that cannot be waived by agreement.
20.5 Language and currency. These Terms are written in English. Any translation is provided for convenience only, and the English version controls. Communications about your Application and the Program will be in English. All amounts referred to in these Terms are in U.S. dollars.
21. General Provisions
21.1 Entire agreement. These Terms are the entire agreement between you and Mecavoy regarding your Advisor Account, your Application and the Program, and they supersede all prior or contemporaneous statements, understandings and communications about those subjects, including statements on the Mecavoy website. The Privacy Policy explains how Mecavoy handles personal information and does not form part of these Terms.
21.2 Order of precedence. If these Terms conflict with any statement on the Mecavoy website or in any email about the Program, these Terms control. Once signed, the Advisor Agreement controls over these Terms as provided in Section 10.2.
21.3 Assignment. You may not assign or transfer these Terms, or any right or obligation under them, without Mecavoy’s prior written consent. Mecavoy may assign these Terms, on notice to you, to an affiliate or to a successor in connection with a merger, acquisition, reorganization or sale of all or substantially all of its business or assets. Any attempted assignment in breach of this Section 21.3 is void.
21.4 No waiver. A failure or delay by either party in exercising any right under these Terms does not waive that right, and a waiver of one breach is not a waiver of any other breach. A waiver is effective only if it is in writing.
21.5 Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions continue in full force and effect.
21.6 No third-party beneficiaries. These Terms are for the benefit of you and Mecavoy only, and no other person has any right to enforce them, except that the persons indemnified under Section 19 may enforce that Section.
21.7 Survival. Sections 2.5, 2.6, 3.5, 4, 5.4, 5.6, 6.5, 9, 11, 12, 13, 14.1, 18, 19, 20, 21 and 22, and any other provision that by its nature is intended to survive, survive the withdrawal or decline of your Application, the deletion or closure of your Advisor Account and the end of your participation in the Program.
22. Notices and Contact
22.1 Notices to Mecavoy. Notices to Mecavoy under these Terms must be sent by email to support@mecavoy.com or, for matters concerning personal information, to privacy@mecavoy.com, or by mail to Mecavoy LC, 5830 E 2nd St, Ste 7000 #38404, Casper, WY 82609, United States. A notice to Mecavoy is effective when Mecavoy receives it.
22.2 Notices to you. Mecavoy will send notices to you by email to the email address of your Advisor Account or, if you do not have one, to the address in your Application, as updated under Section 14.4. A notice sent by email is treated as received when it is sent, unless Mecavoy receives notice that it was not delivered.
Version History
This version history is provided for information and does not form part of these Terms.
Version 1.3, September 29, 2026. Version 1.3 applies to Advisor Accounts created, and Applications submitted, from its publication on September 29, 2026. The version that applies to an Application is the one recorded as accepted with it (Section 2.2), subject to Sections 17.4 and 17.5. The principal changes are as follows:
- Section 7.1(b) replaces the first year of Mecavoy advisor membership at no charge with 50 percent off the first year of Mecavoy membership: US$214.50 for Registered Advisor membership, then US$429 a year, with invoicing tools included and no invoicing fee, and US$124.50 for Independent Agent membership, then US$249 a year, with Independent Agent membership charged from January 2027. Section 7.1 provides the Founding Advisor Benefits only if Mecavoy approves the Application within the time stated in Section 7.2.
- Section 7.2 limits places in the founding cohort to applicants whose Applications Mecavoy approves by 11:59 p.m. Eastern Time on January 31, 2027.
- Section 7.5 is added. It states that membership is provided and charged under the membership terms of the Mecavoy Service, and not under these Terms, and that those membership terms will be consistent with Section 7.5. Membership is charged on the Mecavoy Service when it starts there, never when an Advisor Account is created or an Application is submitted, and Independent Agent membership is not charged before January 2027. Membership fees are paid by card, including by Independent Agents outside the United States. The price follows the track on which Mecavoy approves the Application. The first year is the 12 months from the first membership charge. Membership renews automatically each year at the full annual price then in effect until canceled; before the first charge Mecavoy shows the renewal price and date and asks, with a box that is not checked in advance, for a separate consent to automatic renewal, and accepting these Terms is not that consent. Mecavoy emails a reminder, stating the renewal date, the price and how to cancel, about 30 days and about 7 days before each renewal. Membership can be canceled online at any time; canceling stops the next renewal, and the membership continues to the end of the year paid for, whose fee is not refunded except under the guarantee or where the law requires. The first charge and each renewal carry a 14-day money-back guarantee: a full refund to the original payment method, asked for online or by email within 14 days, with no reason needed, after which the membership ends, limited to one refund per person for each type of membership in any 12 months. The guarantee covers membership fees only; other fees and bookings are governed by their own terms.
- Sections 2.4, 10.1 and 18.6 state that membership fees are charged under the membership terms of the Mecavoy Service, as Section 7.5 describes, and not under these Terms, in place of the statements that no fee is charged and that fees are set out only in the Advisor Agreement. The heading of Section 2.4 is changed to match. Section 18.3 adds membership fees paid in the 12 months before a claim to the measure of the limit of liability, and Section 18.6 no longer states that the limit is one hundred U.S. dollars.
- Section 3.3(c) adds Syria and mainland China, which does not include Hong Kong, Macao or Taiwan, to the Restricted Territories, and Section 3.3 states that the places in item (c) are Restricted Territories as a business decision based on Mecavoy’s own assessment of risk. Section 3.4 states that, at the date of this version, the Program is not yet open in, among other places, the member states of the European Union and the European Economic Area, the United Kingdom and Switzerland.
- Section 3.9 is added. Applicants who reside in California, Florida, Hawaii or Washington may apply, and Mecavoy may verify and approve their Applications, but Mecavoy will not offer them Briefs until it is registered to sell travel in their state, which it expects by December 2027. Section 14.2 adds the email that tells them when Mecavoy begins to offer Briefs to advisors in their state.
- The definition of “Mecavoy Service” in Section 2.5 and Section 6.4 state that the Mecavoy Service is scheduled to open to founding advisors for early access in December 2026, and to Travelers across the United States in January 2027. Section 4.8 refers to the move of Advisor Accounts to the Mecavoy Service in place of its launch, and its heading is changed to match. Section 4.8(b) states that the two-step sign-in secret and recovery codes are not moved and that two-step sign-in is set up again on the Mecavoy Service, in place of the statement that Mecavoy may be unable to move two-step sign-in settings.
- Section 17.5 is added. Anyone who submitted an Application under Version 1.2 or an earlier version, or accepted Version 1.2 when creating an Advisor Account, keeps the first year of Mecavoy advisor membership at no charge in place of the benefit in Section 7.1(b) of this version, even after accepting this version. The time stated in Section 7.2 does not apply to that first year, and Section 7.5 applies to any membership charged after it. Section 17.4(c) refers to Section 17.5.
- The summary at the top of this page is updated to match. It adds the founding price, automatic renewal and money-back guarantee, the places where the Program is not yet open, the rule for applicants in California, Florida, Hawaii and Washington, and the first year at no charge kept under Section 17.5.
An Application submitted while Version 1, Version 1.1 or Version 1.2 was published remains governed by that version unless the applicant accepts Version 1.3, either when Mecavoy asks the applicant to do so by email or, where Section 17.4 applies, when the applicant creates an Advisor Account, as Sections 17.2 and 17.4 provide. An applicant who accepts Version 1.3 keeps the first year of Mecavoy advisor membership at no charge, as Section 17.5 provides. Where a provision of Version 1.3 is more favorable to an applicant who applied under Version 1 than the corresponding provision of Version 1, Mecavoy applies that provision to the Application, as Section 17.3 provides.
Version 1.2, September 28, 2026. Version 1.2 applies to Advisor Accounts created, and Applications submitted, from its publication on September 28, 2026. The version that applies to an Application is the one recorded as accepted with it (Section 2.2), subject to Section 17.4. The principal changes are as follows:
- Applying now requires an Advisor Account with an email address confirmed by a six-digit code. Section 2.5 adds the definitions of “Advisor Account” and “Advisor Console” and gives the new address of the Application Form, mecavoy.com/advisor/apply. Section 2.2 provides that these Terms are also accepted when an Advisor Account is created, Sections 1.1 and 2.1 add the Advisor Account to the parties to and the scope of these Terms, and Section 14.1 is updated to match.
- The heading of Section 4 is changed to match its contents. Section 4.5 allows one Application under review or approved at a time, submitted through the applicant’s own Advisor Account, in place of the Version 1.1 rule of one Application per person, and links an Application submitted before Advisor Accounts were available to the Advisor Account that uses the same confirmed email address.
- Section 4.6 is added. It sets out who may create an Advisor Account, the rule of one Advisor Account per person, the holder’s responsibility for the security of the password and, if two-step sign-in is turned on, of the authenticator app and recovery codes, how Mecavoy may turn off two-step sign-in when both the authenticator app and the recovery codes are lost, when Mecavoy may suspend or close an Advisor Account, sign it out of every browser or require a new password, account emails, and changes of email address, which may be requested from support@mecavoy.com or privacy@mecavoy.com. It states that the country of residence given when an Advisor Account is created is checked but not kept on Mecavoy’s systems, and that Section 3.4 or Section 3.3 applies if the holder’s Country of Residence later changes.
- Section 4.7 is added. It states when an applicant may apply again: after a withdrawal, at any time; after a decline, 180 days after the decision unless Mecavoy allows an earlier Application; and in either case no more than three Applications in any 12 months. It also states that no new Application may be submitted while the Advisor Account is suspended, or while applicable law requires Mecavoy to keep records of an earlier Application, and that Mecavoy keeps a record of when each Application was submitted for at least 12 months to apply the limit. It further states that a new Application is governed by the version of these Terms in effect when it is submitted and is reviewed afresh, that Mecavoy may take into account the information about earlier Applications that it keeps under Section 13.3, and that deleting an Advisor Account and creating another does not change when the holder may apply again.
- Section 4.8 is added. It describes what Mecavoy intends to do with Advisor Accounts when the Mecavoy Service launches, including where the holder must choose a new password when the move happens.
- Section 9.1 states that the name of the Independent Agent Track follows travel-industry usage and does not make an advisor an agent of Mecavoy, and that Section 9 applies on both tracks.
- Section 13.1 extends to personal information in an Advisor Account and refers to the Privacy Policy’s section on founding advisor applications and Advisor Accounts.
- Section 13.3(d) states that the automatic deletion of files never submitted with a completed Application can take a few more days to complete.
- Sections 13.3(c), 13.5, 15 and 16.1 describe withdrawing an Application and deleting an Advisor Account in the Advisor Console, and what then happens to the Application and its documents. Section 13.3(c) also covers an Advisor Account that Mecavoy closes under Section 16.2, and allows Mecavoy to keep an Application and its documents to the extent the Advisor Agreement requires. Section 13.3(e) adds the deletion or closure of the Advisor Account to the cases in which Mecavoy keeps the records of a screening that confirmed that an applicant is a Restricted Party, and the information in the Application needed to identify the applicant and to show what was screened and decided, while the documents and the rest of the Application are still deleted as Section 13.3 otherwise provides. Section 15 states that a withdrawal cannot be undone and that withdrawing an approved Application ends participation in the Program and releases the place in the founding cohort. Section 16.1 allows an Advisor Account to be deleted by email to support@mecavoy.com or privacy@mecavoy.com, states that the deletion cannot be undone, and makes its effect on participation in the Program subject to Section 16.4. Section 16.2 adds the suspension or closure of an Advisor Account to the measures that Mecavoy may take.
- Section 14.2 lists the account and security emails. Section 14.3 adds privacy@mecavoy.com to the addresses to which an applicant may write to stop advisor news. Sections 14.4 and 22.2 refer to the email address of the Advisor Account, and Section 14.4 allows a change of email address to be requested from support@mecavoy.com or privacy@mecavoy.com.
- Section 17.2 provides that a later version of these Terms may also be accepted by creating an Advisor Account, as Section 17.4 provides. Section 17.4 is added. It explains how these Terms apply to an Application submitted before Advisor Accounts were available, and states that, when Mecavoy links that Application to the applicant’s Advisor Account, it records with the Application the version accepted when the account was created and the date and time of that acceptance.
- Section 18.1 extends the disclaimer of warranties to the Advisor Account and the Advisor Console, and Section 21.1 adds the Advisor Account to the subjects of the entire agreement.
- Section 21.7 adds Sections 2.5, 2.6 and 6.5 to the provisions that survive, and adds the deletion or closure of an Advisor Account to the events they survive.
- The summary at the top of this page is updated to match. It also states that the location rules in Section 3.8 limit where an applicant outside the United States may work, and that an Application may be withdrawn only before the Advisor Agreement is signed.
An Application submitted while Version 1 or Version 1.1 was published remains governed by that version unless the applicant accepts Version 1.2, either when Mecavoy asks the applicant to do so by email or when the applicant creates an Advisor Account, as Sections 17.2 and 17.4 provide. Where a provision of Version 1.2 is more favorable to an applicant who applied under Version 1 than the corresponding provision of Version 1, Mecavoy applies that provision to the Application, as Section 17.3 provides.
Version 1.1, September 26, 2026. Version 1.1 applies to Applications submitted from its publication on September 26, 2026. The version that applies to an Application is the one recorded as accepted with it (Section 2.2). The principal changes are as follows:
- Sections 3.2 to 3.4 open the Independent Agent Track to individuals whose Country of Residence is listed on the Application Form, in place of the Version 1 rule that every applicant reside in the United States, and allow Mecavoy to pause a review or participation if an applicant moves to a place that is not listed. The Registered Advisor Track remains open only to individuals who reside in the United States, applying for businesses organized or registered there. Section 2.5 adds the definitions of “Country of Residence”, “OFAC”, “Restricted Party”, “Restricted Territory” and “Sanctions Laws”, moves the definition of “United States” there from Section 3.2, and states that the Registered Advisor Track is for travel businesses in the United States.
- Sections 3.3 and 3.5 add the Restricted Territories, the sanctions representations and the screening of applicants, and on the Registered Advisor Track their businesses, against U.S. government restricted-party lists, and Section 5.1(f) adds that screening to the verification checks. Section 6.1 states that Mecavoy’s commitment on protected characteristics yields where the Sanctions Laws require, and Section 16.3 states that the opportunity to remedy does not apply where the Sanctions Laws or other applicable law require Mecavoy to act without delay.
- Section 3.1(a) requires applicants to have reached the age of majority where they reside, if it is higher than 18.
- Sections 3.6 and 3.8 describe the registrations and licenses that applicants must hold, including for travel on which they advise, and the responsibilities of applicants who reside outside the United States. Section 8.2(d) refers to Section 3.6, and Section 9.2 makes an applicant’s choice of location subject to Section 3.8(b). Section 4.1 requires applicants to tell Mecavoy of a change to their Country of Residence, while their Application is under review and while they participate in the Program.
- Section 5.1(a) states that an identity check may include a video call on which the applicant shows an official photo identity document, and Sections 5.5 and 5.6 describe the verification of applicants who reside outside the United States and the handling of identity documents.
- Section 8.2 adds anti-corruption and sanctions standards of conduct.
- Section 9.3 describes responsibility for taxes and the tax form that Mecavoy requests before any payment under the Advisor Agreement.
- Section 13.3(e) describes the retention of screening records, and Section 21.7 adds Sections 3.5 and 5.6 to the provisions that survive.
- Section 17.3 is added. It states that an Application submitted under Version 1 remains governed by Version 1, and that where a provision of Version 1.1 is more favorable to the applicant, Mecavoy applies that provision to the Application.
- Sections 20.3 to 20.5 limit the small-claims provision to U.S. courts, extend the mandatory-protections provision to the country in which the applicant resides, and state that these Terms are in English and that amounts are in U.S. dollars.
- The summary at the top of this page is updated to match.
An Application submitted while Version 1 was published remains governed by Version 1, and the applicant keeps every right that Version 1 gave them, unless the applicant accepts Version 1.1 when Mecavoy asks, as Section 17.2 provides. Where a provision of Version 1.1 is more favorable to that applicant than the corresponding provision of Version 1, Mecavoy applies that provision to the Application, as Section 17.3 provides.
